By accessing the Website, creating an account, or placing an order, you ("User", "you") agree to be bound by these Terms. If you do not agree, please do not use the Website.

1. Scope — Online Sales vs. Retail Counters

"Howrah Blue Print" (also referred to as "HBP") for the purposes of the Website and any related mobile application is a unit/brand of HBP Healthcare Private Limited. As of the date of this Policy, only sales made through the Website and app are transacted by and under the responsibility of HBP Healthcare Private Limited. Physical retail counter sales at Howrah Blue Print branches are, as of the date of this Policy, operated separately and are not covered by this Policy. Other Howrah Blue Print branches/retail counters may be brought under HBP Healthcare Private Limited in the future, at which point this Policy may be revised accordingly.

These Terms apply only to purchases made through the Website/app and do not govern purchases made in person at any physical retail counter.

2. Definitions

  1. "Products" means pharmaceutical, healthcare, wellness, and allied products listed for sale on the Website.
  2. "Services" means any booking, delivery, or allied service offered through the Website.
  3. "Order" means a request placed by the User to purchase Products or avail Services through the Website.

3. Eligibility

The Website may be used only by individuals who are 18 years of age or older and who are legally capable of entering into a binding contract under the Indian Contract Act, 1872. By using the Website, you represent that you meet this requirement.

4. Account Registration

You may be required to register an account to place Orders. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate, current, and complete information at all times.

5. Products, Prescriptions, and Regulatory Compliance

Howrah Blue Print operates as a pharmaceutical retail and wholesale distribution business. Sale of Products through the Website is subject to applicable law, including the Drugs and Cosmetics Act, 1940, and rules made thereunder.

  1. Schedule H, H1, and X drugs (and any other Products legally requiring a prescription) will be dispensed only against a valid prescription issued by a registered medical practitioner, verified by our registered pharmacist prior to dispatch.
  2. We reserve the right to refuse an Order where a valid prescription is not provided, is incomplete, or is reasonably suspected to be invalid.
  3. Our drug licence for online/website-based dispensing is currently in process with the relevant licensing authority. Until such licence is granted, sale of scheduled drugs through the Website may be limited or unavailable, and the Website may operate on an information/order-enquiry basis for such Products.
  4. Product images, descriptions, and packaging shown on the Website are for reference only and may vary from the actual Product delivered, subject to manufacturer changes.

6. Orders and Order Acceptance

Placing an Order constitutes an offer to purchase. An Order is deemed accepted only upon our confirmation (via email, SMS, or in-app notification), not upon mere submission or payment. We reserve the right to cancel or refuse any Order at our discretion, including for reasons of stock unavailability, pricing errors, suspected fraud, or non-compliance with prescription requirements, in which case any amount paid will be refunded as per our Return and Refund Policy.

7. Pricing and Payment

  1. All prices are listed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise.
  2. Payments are processed through a third-party payment gateway. We do not store your card, UPI, or net-banking credentials; these are handled directly by the payment gateway provider under its own security standards.
  3. We are not liable for any delay, failure, or error in payment processing caused by the payment gateway, your bank, or your network provider.
  4. In case of a failed transaction where an amount has been debited, the amount will ordinarily be reversed by the payment gateway/bank within their standard timelines; you may also reach out to us for assistance.

8. Delivery

  1. Delivery timelines shown on the Website are estimates and not guaranteed delivery dates.
  2. Risk in the Products passes to the User upon delivery at the address provided at the time of Order.
  3. It is the User's responsibility to provide an accurate delivery address and to be available (or nominate someone) to receive the Order, particularly for scheduled drugs requiring prescription verification at the point of delivery.
  4. We are not responsible for delays caused by incorrect address information, unavailability of the recipient, or circumstances beyond our reasonable control (force majeure).

9. Cancellations, Returns, and Refunds

Cancellation, return, and refund of Orders are governed by our separate Return and Refund Policy, which forms part of these Terms.

10. User Obligations

  1. Not to misuse the Website for any unlawful purpose, including submitting fraudulent prescriptions or false information.
  2. Not to attempt to gain unauthorised access to the Website, its systems, or other users' accounts.
  3. Not to resell Products purchased through the Website in violation of applicable law or your licence terms, where applicable.

11. Intellectual Property

All content on the Website, including the Howrah Blue Print name, logo, text, graphics, and software, is the property of Howrah Blue Print or its licensors and is protected under applicable intellectual property laws. No content may be copied, reproduced, or used without prior written consent.

12. Limitation of Liability

To the maximum extent permitted by law, Howrah Blue Print shall not be liable for any indirect, incidental, or consequential loss arising from the use of the Website or Products, except in cases of proven negligence or wilful default on our part. Nothing in these Terms limits liability that cannot be excluded under applicable Indian law, including in relation to defective drugs.

13. Indemnity

You agree to indemnify and hold Howrah Blue Print, its officers, and employees harmless from any claim or demand arising out of your breach of these Terms, misuse of the Website, or violation of any applicable law, including submission of a fraudulent or invalid prescription.

14. Grievance Redressal

In accordance with applicable law, grievances relating to the Website or Orders may be addressed to our Grievance Officer at info@howrahblueprint.com. We will endeavour to acknowledge and resolve grievances in a timely manner.

15. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. Subject to applicable law, the courts at Howrah/Kolkata, West Bengal shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

16. Amendments

We may revise these Terms from time to time. The updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Website after such changes constitutes acceptance of the revised Terms.
